  • Business associates become directly subject to most of the same rules and penalties as covered entities, effective February 2010. What does it mean for plans and service providers?
  • Do business associate agreements need to be amended for the changes to the privacy and security provisions?
  • Starting in September, health plans, business associates and certain other entities must disclose breaches of unsecured PHI (to affected individuals, government agencies and sometimes even to the media!). How do the new rules work?
  • What types of revisions will be required to privacy notices and policies and procedures due to changes in individual privacy rights?
  • The new enforcement rules, including not only significant increases in penalties but also required HHS audits and enforcement by state attorneys general.
