The DOL has issued final regulations requiring service provider fee disclosures effective July 1, 2012. Under the final rules, service providers for 401(k) and other pension plans must disclose information designed to help plan fiduciaries determine the reasonableness of service provider arrangements. In this 90-minute web seminar, our experts will provide background on the rules and then focus on changes made by the final regulations. The program will also address the new requirements to coordinate with the participant-level fee disclosure rules.

- Expanded disclosures for indirect compensation to assist plan sponsors in identifying potential conflicts of interest among its service providers and their affiliates.
- New requirements for designated investment alternatives to facilitate the participant-level fee disclosures. (Please note: Participant-level fee disclosures will not be covered in detail.)
- New standard for providing timely disclosures to comply with Form 5500 and participant-level fee disclosure requirements.
- Changes to the requirements for updating disclosure, specifically the requirement that investment-related disclosures be made “at least” annually.
- Tightened standards for fiduciary relief from liability for disclosure failures that require, among other things, prompt decisionmaking.
