Here’s some of what was covered:

  • Outsourcing COBRA administration. What is the effect on COBRA liabilities, and how are deadlines calculated when a third party handles COBRA notices?
  • Loss of coverage in anticipation of divorce. Should you contact spouses or dependents dropped at open enrollment? How should the anticipation of divorce rules be administered and explained in COBRA communications?
  • Second qualifying events. Should another notice of COBRA rights be provided for second qualifying events? Are you treating legal separations and Medicare entitlements as second qualifying events when it isn’t required?
  • COBRA election period. What are the issues in calculating the 60-day period? What should be done about COBRA elections that are late by only a few days?
  • Leaves of absence. What COBRA rights apply to a combined FMLA/non-FMLA leave? How should you coordinate the different rules for COBRA and USERRA continuation coverage?
  • COBRA in mergers and acquisitions. Are you familiar enough with the special COBRA rules that apply in business reorganizations?
