eBook License Agreement

Our eBooks contain copyrighted material. Your use of the eBook constitutes your agreement to the terms and conditions set forth in this License Agreement. Please read the entire License Agreement carefully.
The Employee Benefits Institute of America Inc. (EBIA) agrees to grant, and the user of the eBook agrees to accept, a nonexclusive license to install and use the eBook under the following terms and conditions.
eBook Usage
The EBIA eBook may be used by one user on one computer. The user of the eBook shall be subject to all of the terms of this License Agreement, whether or not the user was the purchaser. The same user may also use the eBook on his/her portable or home computer (you must call EBIA to authorize the additional computer). If you need access for more than one user, please contact EBIA at (866) 775-3242.
Annual Subscription
If you have purchased an annual subscription, you are entitled to access and view the current quarterly edition of the eBook plus the next three quarterly editions, until each edition’s expiration date, which is approximately one month after the next edition is released. You will not be able to access or view the eBook after that edition’s expiration date (of course, you will be able to access and view the subsequent quarterly edition if your subscription remains active).
Printing
You may occasionally print a few pages of the eBook’s text (but not entire Sections) for your personal use, which may include sending the printed pages to a co-worker or client who has requested information from you (but you must warn him/her in writing that copyright law prohibits him/her from redistributing those pages to anyone else). Other than as set forth above, you may not print pages and/or distribute eBook content to others.
Copyright, Use, and Resale Prohibitions
All content in the eBook is copyrighted under the U.S. Copyright laws, and EBIA owns the copyright and the eBook itself. Other than as stated in this License Agreement, you may not copy, print, modify, remove, delete, augment, add to, publish, transmit, sell, resell, create derivative works from, or in any way exploit any of the eBook’s content, in whole or in part, and you may not aid or permit others to do so. The unauthorized use or distribution of copyrighted or other proprietary content is illegal and could subject the purchaser to substantial money damages. Purchaser will be liable for any damage resulting from any violation of this License Agreement, including any infringement of copyrights or proprietary rights.
No Transfer
This license is not transferrable by the eBook purchaser unless such transfer is approved in advance by EBIA. Provided, however, that the purchaser of a “standard option” manual subscription may give his or her copy of the eBook to a co-worker to use, in which case the co-worker will be subject to the terms and conditions of this License Agreement.
Disclaimer
“This [eBook] publication is designed to provide accurate and authoritative information in regard to the subject matter covered. [A license to use the eBook] is sold with the understanding that the publisher is not engaged in rendering legal, accounting, or other professional service. If legal advice or other expert assistance is required, the services of a competent professional should be sought.” (From a declaration of principles jointly adopted by a committee of the American Bar Association and a committee of publishers and associations.) EBIA does not guarantee that the information in the eBook is error-free or warrant that the eBook will meet your requirements or that the operation of the eBook will be uninterrupted or error-free. The eBook is provided “as is” without warranty of any kind, either express or implied or statutory, including, without limitation, implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the results and performance of the eBook is assumed by you. In no event will EBIA be liable for any damages, including, without limitation, incidental and consequential damages and damages for lost data or profits arising out of the download or use of the eBook or the inability to use it. The entire liability of EBIA shall be limited to the amount actually paid by you for the eBook license.
Your Agreement
Your use of the eBook constitutes your agreement to the above terms and conditions.
